Employer Cannot Be Liable For Employee'S Suicide

The employers will heave a sigh of relief with the latest judgement passed by the Supreme Court. The apex court ruled that the employer/boss cannot be held guilty for the suicide committed by an employee, even if the latter was at wrong.

The Supreme Court also said that there has to be strong evidence to prove that the accused had instigated or conspired with others to force the victim commit suicide.

 

However, the court also ruled that if there was any conflict between the person and his superior officer and if the suicide takes place on account of that conflict, wrong doing or grudge, the boss cannot be held guilty.

 

The Section 306 of the IPC refers to abetment of suicide which carries a punishment of imprisonment up to 10 years. The Supreme Court passed the judgement while hearing the case Madan Mohan Singh vs late Deepakbhai Kishanla Joshi (Ahmedabad).

 

Joshi was working as a driver of Mohan Singh. He committed suicide and left a suicide note, which said, "I am going to commit suicide due to his functioning style. Alone MM Singh, D.E.T Microwave project is responsible for my death".
