    • FREEDOM FOR BABUS
    The Honourble Supreme Court of India delivered in what is now called a landmark judgment comprising a series of guidelines to the Union and State Governments in the matters of posting of Bureaucrats who are pretending to be bulldozed by the political executive of the day. The judgment had reiterated what theGovernment appointed committes suggested including the ARC headed by our present Minister for Oil and Petroluem Dr.Veerappa Moily. It has wanted a formation of a council of Civil servants to advise the government on postings, transfers etc and to ensure a fixed tenure for our babus. It has asked the Babus not to take oral orders, insist on written orders by the political masters. While advice of the council will not be binding with the Executive reserving the right to defer but it has to record its reasons for not accepting the recommendations. Some retired civil servants who had petitioned the SC on this issue of political interference, forgot that it is thepolitical executive that holds the people's mandate to govern which means to enact laws, rules, bye laws , take policy decisions, and theBabus are expected to follow what the political executive directs them to do. The Ministers are accountable to Parliament and these days Babus conveniently leak out government decisions through media channels and the media fights for them. That is why retired CBI Director could insinuate that Rajiv wanted kickbacks in defence deals to be used for party funding. Rajiv is no more to defend him and the babu claims that these were uttered to him by the late PrimeMinister over a cup of coffee. This after many years of mud slinging, theDelhi High court concluded that there is no ioata of evidence to suggest that Rajiv took money in Bofors deal. Even the Police man who blew the whistle on this deal, has denied any clinching evidence to suggest that Rajiv indeed took kickbacks.

    It is true, there are upright and honest officers and these people always stand up to Executive. The political leadership also to a large extent respect their views. There are also people who sensationalise issues like Ashok Khemka who despite an impeecable record have a penchant in running down to mighty people at any  pretext to exhibit their bloated egoes. SC dismissed a petition as frivolous requirinCBI investigation in to land deals of Vadra which was claimed to be have been exposed by Khemka.

    I feel SC has exceeded its brief in advising on such matters even though it was only reiterating the recommendations of official committes which were also to a large extent headed by former bureaucrats. It is like the collegium system of selecting judges.
