Samsung Filed A Complaint against Apple on Tuesday
On Tuesday, Dusseldorf (Germany) Higher Regional Court said Samsung had filed an appeal to against the adjudication which been made last week that prohibited Samsung to sell its Galaxy Tab 10.1 Tablet in Germany. That court suggested in an announcement on that day that Samsung didn’t expound its reason. In that adjudication, Samsung can’t sell Galaxy Tab 10.1 Tablet in market of Germany, and Samsung’s German subsidiary can’t sell Galaxy Tab 10.1 in the entire EU market. Now according to media’s report, On Monday, Samsung Electronics confirmed that it filed a complaint against Apple, Inc. in France for infringing on three of their patents. It looks like Samsung is trying a different approach.
Apple recently received an injunction against Samsung in Germany based on the physical attributes of the Galaxy Tablet 10.1. The latter is trying to gain support for the technical patents instead. The Samsung complaint was filed in July, but is not expected to be heard until this coming December. The complaint is against Apple’s iPhone 3G, iPhone 3Gs, iPhone 4 and both generations of the iPad. The two technology companies have been battling it out in the patent courts since April of this year when Apple filed complaints against Samsung for copyright infringement of their smart phones and tablets. Samsung filed counter suits in the U.S., claiming that Apple infringed on 10 of their patents. Since then, both companies have filed complaints against each other in Europe, Australia and Asia as well.
And let’s back, previously, Apple claimed that the Tablet PC Android of U.S. version violated 10 patents of company. While the lawyers from Samsung argued the Galaxy Tab 10.1 Tablet PC sold in Australia wasn’t same with American version, so Apple should not prosecute the patent issues of Australian version according to American version, by mutual agreement, the Samsung agreed to send this product to Apple to confirm whether it infringed the patent of Apple or not at least 7 days before releasing it. Then Samsung denied the suspension of Samsung Galaxy Tab’s releasing in Australia and announced they would release it as the original plan. According to the news that Ausdroid got from Samsung, the agreement that reached between Samsung and Apple was only for American version which had patent dispute, and Australian version was not same as American version, thus avoiding the problem of paten infringing In addition, although Apple prosecuted Samsung because these patent disputes to the central court of Australia.
