This agreement has been submitted to the federal court in Brooklyn on Thursday, which will end Apple Story and Fun Zone's trademark infringement lawsuit in July last year, these two shops are both located in New York Queens Chinatown selling the shell, earphone and other accessories of iPhone, iPad, iPod and other Apple products. However, these two stores insisted that they did not infringe any trademark of Apple.
If the United States District Judge Kiyo Matsumoto approve the settlement, then the two stores will have five days to transfer any infringing products in stock, as well as any products, labels, packages, promotional materials and other items with Apple trademark. According to the court documents submitted by Apple, the unauthorized iPhone and iPod case design sold by these two stores mimiced the iPhone and iPod design, and even with "designed by Apple in California, Assembled in China" words. As part of the settlement agreement, Apple Story has agreed to change the name. Apple think that the store's name is too similar to its "Apple Store" trademark.
In addition, the owner of Apple Story Janice Po Chiang, Fun Zone manager Jimmy Kwok and other defendants are also prohibited to destruct the manufacture, distribution, sale or receipt records of the shells and headphones which are identified as counterfeit by Apple.
Apple spokesman declined to comment on the settlement agreement, both lawyers didn't comment too. For more, you can click here: http://www.convertvideotoipad.org/mac-ipad-video-converter.html
