Ironically, the HRD ministry had given its not the Office to investigate the allegations against VN Rajsekharan Pillai, VC, Indira Gandhi National Open University (IGNOU), 10 days before the summit. The permission of the Department to investigate allegations against Pillai was given a year after the declaration of the CBI. The first request was made in November 2010, followed by a booster in September this year.

In early 2007, UGC-AICTE-DEC has signed a Memorandum of Understanding (MoU) to jointly approve and monitor the institutions offering technical courses through distance mode. The memorandum stated that the approval of any institution should be given jointly by the three parties.

In case of EMS, it was decided that the recommendation will be given after a visit to Manipal University Distance Education. The inspection report IGNOU pro-rector made the following recommendations: EMS teachers need guidance for credits, course content, in some cases inadequate, MBA distance education must be greater than two years, and educational material needs to be modernized. Based on this report and the expert's report before EMS committee was told not to confess until it complies with these recommendations.

Later, pledged that SMU has decided to comply with all the suggestions. Pillai has given recognition to SMU for one year provided that. A month later, the director of December presented a note to Pillai, adding that SMU has met all standards. Pillai, as Chairman of the Distance Education Council(DEC), did not submit the compliance report of the Joint Action Committee (JAC) of the UGC-AICTE-December as planned, but unilaterally gave an extension of three years in the SMU.

Pillai also faces a charge to give a three-year extension at the Technical University of Punjab without placing the compliance report before the UGC-AICTE-JAC in December.
