EFFECT OF EFFECTIVE JUDICIAL SYSTEM ON CRIME IN BIHAR

Over 12000 criminals in Bihar people punished in 18 months (January 2006 to June 2007): 625 sent to prison for a decade or more, 2668 sent to prison for life, 28 punished with death by hanging and punishments are still going on by different district trial courts. These speedy trials convictions are definitely set a new metaphor for Bihar law and order where the accused (criminals) often take advantage of by either skipping out on bail or simply leaning on the confidence that justice was far away.
By the effective and supportive efforts of both Bihar Judiciary and state prosecuting agencies (police, CID, Vigilance) the criminals are putting behind the gallows speedily is the instances undoubtly morale booster for the law enforcers and catalyst in evaporating the fear psychosis of the people residing in the infamous badland of India.
The statistics of fast track convictions in January 2006 to June 2007 revealed that altogether in 5854 criminal cases for offences under Indian Penal Code and Arms act total 12443 criminals were convicted by different trail courts across the state. In conviction, category total 28 criminals were punished with hanging, 2668 punished for lifer, 625 punished for a jail term more than 10 years whereas 9122 punished for a jail term less than 10 years.
When contacted many prominent lawyers of the Patna high court on the recent fast track convictions fast rate majority of the same opinion “speedy trials are important as justice delayed is justice denied”. However, a few lawyers also cautioned about the quality of evidence and justice being dispensed in such a short time in a country where court cases typically drag on for years but it is undisputed that “speedy trial is essential as delays usually go in favour of the accused”.
Instances of fast track punishments by FTCs recently in Bihar
In July 2006, Sasaram district court concluded the trial of a sensational rape case within ‘ 2- days’ and sentenced the accused to seven years imprisonment. The heinous crime relates to the rape of minor girl in Babhanaul village of Dawath police station of Rohtas district on December 23, 2005 while she had visited her field for picking vegetables.
The district court Sasaram in May 2006 concluded kidnapping trial in record 18 days and awarded life sentence to nine persons for kidnapping an eminent doctor on February 7 of last year.
A Fast Track Court of Kisanganj presided by Additional district judge took just four months to sentence a man to life in May 2006 for abducting the three-year-old girl and raping her on January 27.
In Prashant Jain kidnapping case, Bunty-kidnapping case all the kidnappers in duo infamous kidnapping case of state capital were sentenced for life in a 100 trial by Patna district court in 2007 itself.
