MERCY PETITIONS

Suddenly there are protests against inordinate delays in disposal of clemency pleas and a c horus of calls to commute death sentence  in to life imprisonments to those who have pleaded for presidential clemency. The reason adduced is that these convicts have undergone long periods of incarneration enough to drive one insane and have died many a time to borrow a phrase from a leading supreme court lawyer who had penned a lengthy article in The Hindu which also unmasked itself by editorially pleadingn for abolition of capital punishment. I am talking about the pleas of mercy to killers of Rajiv Gandhi for whom even the ruling AIADMK Government passed a resolution in the assembly. When the Madras High Court stayed their execution there was jubiliation all around the court premises with fanatic fringe elements dancing with joy. The mother of one of the convicts Perarivalan individually met political leaders to thank them. Vaiko, the ardent an d unrepenting admirer of LTTE was in the fore front of the team that wanted Rajiv killers freed, walked out of a debate in Times now when the anchor specifically asked as to why he has not taken up the cause of other convicts whose mercy pleas have also been turned down if he were to genuinely believe that capital punishment needs to be abolished. Now SC is hearing a well meant petitition to transfer the case outside Tamil Nadu.

Now it is baffling as to how one can pressurise courts and the President to pardon the ghastly murderers ? It is true there has been inordinate delay in disposal of the mercy petitions but that does not take away the right of the constitutional authority to decide every case by merits. Clemency is to be sought with folded hands and not demanded as a matter of right. Baghiathammal, Perarivalans' mother may be emotinally right in seeking pardon for her son but she should also feel the pain and agony of those who lost their lives and their kith and kin leave alone Rajiv Gandhi against whom the mission to kill was targeted. How come their lives becomes cheaper and dispensable compared to those who are languishing in jail for a hienous crime about which there is not even a sense of remoarse or guilt explicit or implicit in either word or deeds. In all these drama only Dr.Subramanian Swamy speaks sense with other political leaders playing dirty politics in demanding clemency for killers of Rajiv. Omar was right as to how we would have reacted if such a resolution suggesting clemency for Afsal Guru is passed by J&K Assembly. Tamil Nadu CM owes an explanation to the nation as to how she could ask for commuting the death penalty awarded after a due process of law by the highest court of the land? That will set a bad precedent for those who acts against the interests of our nation . The Madras High Court I feel exceeded the brief in admitting the plea itself for it was questioning the sagacity of the competent authority to decide on clemency petitions. Srikrishna Commission of enquiry in to unruly incidents in the precints of Madras High Court pointed out that a section of the judiciary was connving with anti Indian and pro LTTE sentiments and it is high time this case is transferred for an impartial adjudication.
