COST OF JUSTICE

There seem to be never ending controversy on the need to have judicial accountability. The system of elevation of judges through a collegium of Supreme court judges have been objected to by all right thinking people with the Supreme Court stoutly defending the unjust way of judicial promotions. CJI has been one of the vociferous opponents of any alternate system despite the episode involving Justice Dinakaran of Karnataka High Court embroiled in land encroachment. CJI was hesitant to take cognizance of the enormity of the offences the learned Justice Dinakaran is charged with despite mounting evidences. Even though an impeachment proceeding has been admitted in Parliament, CJI has chosen to send Justice Dinakaran to Sikkim High court. Worse he has not bothered about the flurry of protests by the bar of Sikkim court.

CJI also refused to abide by the order of Delhi High court to disclose the assets of Supreme Court judges hitherto submitted to CJI as a matter of propriety. He has advised his registrar to go on appeal against this judgment.

Further CJI also was dismissive of the idea to have Supreme court benches in all four regions of the Country as suggested by National Law Commission. His apprehensions about dilution of the Supreme Court authority is - well - without any basis.

Justice KG Balakrishnan need to leave an indelible foot print in his office before demitting office for he has delivered many land mark judgments befitting his high office. He has to clear the air of disbelief and suspicion he himself has woven around him.
