I had written a letter to Mr. A.P.J. Abdul Kalam, at that time President of Government of India on 24 June 2005, to that he did not bother to reply. I am presenting that letter to my readers here. That letter inadvertently suggests many points of Lokpal bill. I did not get even a simple one line acknowledgement for this letter! However, in one speech later on, he mentioned his desire to be elected by people, the point I have raised in my this letter.

Honorable Dear Sir,

I am writing this letter to your honorable selves to inform you about the things happening around here in our beloved country right under your nose. First of all, you must have observed that I have not called you as 'President of India' but as "President of Government of India”, this may explain to you if you are in a mind to understand the grim situation in which our great nation is fallen. Since, members of elected bodies in our country elected you to the honorable position of Presidentship you do represent only those Houses and not people of the country. If you want to or any other body wants to under various excuses insist to present you as President of India, it will be absolutely unethical to do so on their part. Erroneously or otherwise may be unwittingly this mistake is being continued for all these years and I request your honorable selves to correct this grim mistake and set the things in the right position. The same mistake continues, when mentioning all the ministers of Central Government. Our Prime minister is actually prime minister of Government of India only and not of India. By our constitution, we do not have such positions as president of India and Prime minister of India or defense or finance ministers of India. If you want to call yourself as President of India then, Mr. A. P. J. Abdul Kalam saab should make essential changes in the Constitution of India. All these positions should be, elected at all India level to get the correct representation of the wishes of the People of India. If it is not done then yours calling yourself as "President of India" is Objectionable.

This is not all, I have seen many irregularities in the functioning of our most important and vital system of Judiciary. I have started investigation in these matters under a name "Project investigation of Criminal Practices of Our Judges." A letter to that effect I have written to our honorable Chief Judge of the Supreme Court. I have received my expected response from them. Copy of that letter was, also sent to our esteemed Sabhapati, Loksabha, and Honorable Mr. Somnath Chaterji for his information. A copy of that letter enclosed herewith for your perusal. I want your honorable selves to look into these matters and help correct the situation. If not, then somebody shall do the needful to correct the situation in style & manner they thing proper. The after effect of that will be the responsibility of your Government. Let me also pinpoint to you that the present Government of India is an illegal Government. People have not rightfully elected these people. They are in position by a contrivance only. In addition, we see that not elected people are posing as Home Minister and Aviation Ministers. This is absolutely unconstitutional Act. Total disregard for people's opinion shown in this way is regrettable. We the People of India not taken into confidence and so, I can say that this Government has no right to expect people to obey its orders. Since, this is an illegally formed Government.

According to my observations mixed voting that is, observed for some past elections can best be interpreted as desire of people of India to declare, "Emergency by the People of India". Unfortunately, our Constitution doe not have provision for this eventuality. Moreover, that is the problem. The Constitution provides for Emergency only by president. Author of our constitution never though that political people will misbehave to this extent, may be because during his time political people were great personalities. Therefore, he did not make provision for this eventuality. However, now I thing it has become necessary to do the amendment and provide for Emergency by People. We all know that our present day political parties will not allow such an amendment. Therefore, I request your honorable selves to use your special powers to do it. I also know that you are not strong enough a person to do such a thing immediately on your own.

My concept of "Emergency by the People of India" is thus, In this new situation all political parties and such all politically motivated people must be banned from functioning and all their assets be nationalized. All political leaders are put behind bars and thorough investigation constituted to find out what they were doing when in power? Whereas common citizens will have all the freedoms, they are supposed to enjoy under democracy such as freedom of expression, freedom of movement, freedom of faith and all those personal freedoms. Important NGOs and other social workers who do not have any link whatsoever with any political party called upon to associate with the bureaucracy and together they should manage the countries affairs for at least five years during which period all misbehaving political people shall be punished and a new platform of devoted social workers is created. After that, we can resume once again election schedule. People must have a right to directly convey their grievances to bureaucrats and the bureaucrats shall help solve the problems to their best of capacities.

I have seen during my research of this topic many other discrepancies and to correct them I have to suggest to you following amendments in the judicial system and they are as follows:

A) All Judges, Justice and Magistrates and all such officers (I call all these people such as Judges, Justice and Magistrates etc. as Law Officers for convenience in the following arguments) of the judiciary who are responsible in deciding the future life of many people, must display outside their court-room a detailed bio-data of their respective intelligence as this:

1. Percentage of marks received when he/she passed his/her school-leaving exam.

2. Which year he/she passed?

3. Did they pass in first attempt or what?

4. What were the percentages of marks when he/she passed his/her L.L.B. exam?

5. Which year passed?

6. Which year started practicing Law?

7. How many cases he/she tried?

8. How many cases he/she won?

9. How many cases he/she lost?

10. How many cases remained unresolved?

11. When was accepted in this position (as magistrate or judge or justice as the case may be)? 12) Years of ascends from magistrate to judge level if, years?

12. How many cases tried as that?

13. In how many cases verdict they gave.

14. How many remained unresolved?

B) We the people of India have right to know the intellectual capability of our Law Officers. Presently this is not given. We were taking Law officers of our Government as very intelligent but recent rulings on two cases namely, Iodized salt and Helmet have given clear understanding that our Law officers at the Supreme Court are not as intelligent as we thought them to be. I have reason to accuse these Law officers based on circumstantial evidence that these Law Officers are working to promote some business interest in each of these cases. Many more such cases are being discovered through my previously mentioned Project to know the nexus between these Supreme Court Judges and business Houses. If we allow these Law officers and all those people, who benefit by these activities, to go Scot free that would be dangerous for our future. These Judges are having a free hand on Law, if this is the way things go on then one day these criminal minded Law officers shall sellout even our Democracy to some body for a price! And so these Law Officers must be put to a CBI investigation and for that I suggest to your honorable selves that ALL THESE Law officers be put to a regular C.B.I. investigation from time to time to see what is the link between these people and other vested interests exists. Other people who seem to be involved in this process of converting our Judiciary into a marketing agency are, to my mind, large number of political people, of course, Business Houses and also some journalists. If a Law Officer refuses for such routine investigations by C.B.I., in that case, he shall not be posted in that position. I know this whole thing appears to be very insulting for these Law Officers but after all they are responsible for these stringent measures and so they shall very honorably accept this arrangement. If they have nothing to hide then they have nothing to fear about at all.

C) By legislation, use of phrases such as "Nyaya Devata " and considering these Law Officers as Gods banned. Under the same Legislation, Judiciary called as "Department of Justice" and these Law Officers as "LAW OFFICERS" only. Phrases such as "My Lord" used to call attention of them must be, immediately prohibited under this Legislation and these Law Officers shall be, called for their attention as just "Honorable LAW OFFICER" or "Sir". We are, used to call these positions with great honor but now these old practices must be, stopped to bring these callous and criminal minded Law Officers to their senses. We have accepted Secular environment for our government and in that, environment above given practices do not fit. There is a lot of emotional approach in dealing with these positions and to my mind that practice is harmful to our democracy. All approaches to all these positions should be strictly based on logical thinking and not emotional. There are unnecessary holidays for our Courts, they be reduced to the same as Bank holidays.

D) Presently, Law Officers are, selected from amongst the existing lawyers. Moreover, it is, observed that this practice is responsible for many wrong habits we see amongst these Law Officers. I suggest that on the same line as Indian Auxiliary Service, Indian Foreign Service, and Indian Police Service one more service introduced as “Indian Judiciary Service”. Select first class graduates from Engineering, Medical disciplines, summoned for appointment and be trained for Judiciary work. Only those trained graduates shall be appointed as Law Officers in courts. At present, we select our Law Officers from amongst the practicing advocates. I have found that since, 1970 onwards all first Class students opt for either medicine or engineering studies. Second class and third class students only go for Arts. From amongst these second class and third class students some become advocates. That means at present majority of our lawyers are of second class or third class intellectual capability. That means we select our Judges from amongst these unintelligent people. As a result, we have a gang of stupid, posing as our esteemed Judges! This must be changed.

E) We see many so called Public Interest Petitions are coming up for scrutiny. What is Public Interest? No definition for this is, made. As such almost anything that comes with a few signatures accepted as P.I.L. This must stop. For instance, Iodized salt or Helmet are essentially Personal Interest Matters and public has nothing to do with it. All Personal Interest Matters shall be, excluded from Public Interest Matters. They are both different things and they should not be intermixed. If at all, Judges want to consider these issues. Then whatever they conclude treated as “OPINION” and not “VERDICT”. Opinions are not binding on people, they only suggest. However, Insurance people may use these Opinions while considering the claims.

F) Our Central Government must state publicly what the difference between Tax and Robbery is. Actually, there is very little difference between a Robber and a Government as you must know. Our present Finance Minister has forgotten that he is a minister in a 'supposedly' government and not in a Robber's gang. Tax on withdrawal of your money from your Bank is nothing short of robbery. If Governments start robbery in the name of taxation then this will give incentive to other people to indulge in similar activities. I mean, they shall start cheating Government in their own ways. In addition, Government cannot complain about it. Since, Government itself has started the wrong precedence. You make this Government define Taxation and clarify what in their mind the difference between a tax and a robbery is.

This much is enough for the time being. I formally accuse you of being irresponsible a President and must do something to improve upon this. I accuse you that you do not do anything to improve our Judiciary system, our pickpocket Government and waste your valuable time with children pretending to be a great lover of them. Why you have to do this TAMASHA? Who does not love them? Then why waste time after such trivial things? Things that are more important are awaiting your attention. I have started feeling that you are an opportunist person and not worth becoming a President at all. I am extremely sorry for that I have to condemn you this way but there is no other way to give expression for my feelings at this point of time. One friend of mine said, you are like king Nero of Rome, Rome was burning and King Nero was playing his Fiddle. You are nothing better than that! India is burning under bad rule and here you are playing with children! DO something to demand respect of people of my type. If nothing, at least start dialogue amongst people for and on the topics I have mentioned in this letter. That will give you some Idea as to how to move about in these matters. You shall use not papers and magazines for these but private tele-Channels. Because practically all our newspapers and magazines are already corrupted by stake of politicians, businessmen and above, all by foreign business interests. Using type cast usual so-called experts, should not be taken for the dialogue, but let ordinary people say on my suggestions. People should remember you in the future as a great savior of our Democracy and not as a rocket-Boy turned satellite president, who eats wada-sambar!

Looking forward for your reply, I hope you do have guts enough to reply my letter. I know this letter will disturb you if you are an honest man, but then I wanted it that way.
